Terms of Service

1. Acceptance of Terms

By accessing or using VcodingList at vcodinglist.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and VcodingList.

2. Eligibility

You must be at least 13 years of age to use VcodingList. By using the Platform, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or legal guardian's consent to use the Platform. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Description of Service

VcodingList is a media and product discovery platform for AI-native builders. Users can submit products, upload short promo videos (Shorts), upvote, comment, follow other users, and participate in community-driven leaderboards and rankings.

4. User Accounts

• You must sign in using Google OAuth to access certain features (submitting products, upvoting, commenting, following).
• You are responsible for maintaining the security of your account and for all activities that occur under your account.
• You agree to provide accurate and complete information in your profile.
• You may delete your account at any time through your profile settings. This action is permanent and irreversible.

5. User Content

Submissions

When you submit content to VcodingList (including products, comments, videos, and profile information), you:

• Retain ownership of your original content
• Grant VcodingList a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your content in any media or distribution method (now known or later developed)
• Acknowledge that this license includes the right to use your content for promotional, marketing, and commercial purposes, including but not limited to redistribution on third-party platforms and social media channels (such as TikTok, Instagram, YouTube, X/Twitter, and others)
• Confirm that you have the right to submit such content and that it does not infringe on any third-party rights
• Understand that VcodingList may add branding, overlays, captions, or other modifications to your content when redistributing it

Content Removal

You may delete your submitted content (products, comments, videos) from the Platform at any time. However, you acknowledge that:

• Content that has already been distributed to third-party platforms or social media channels may not be removable from those platforms
• Cached, archived, or derivative versions of your content may persist after deletion from the Platform
• VcodingList retains the license granted above even after content is removed from the Platform, solely for content already distributed prior to deletion

Content Guidelines

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights of others
• Contains malware, spam, or misleading information
• Impersonates another person or entity
• Violates the privacy of others
• Is sexually explicit or promotes violence

6. Products and Rankings

• Products are published immediately upon submission. We reserve the right to remove any product at our discretion.
• Rankings are calculated automatically based on upvotes within calendar-based periods (daily, weekly, monthly, yearly).
• Awards (Gold, Silver, Bronze) are granted automatically to top-ranked products at the end of each period.
• Any attempt to manipulate rankings through fake accounts, automated upvoting, or other fraudulent means is strictly prohibited and may result in account termination.

7. Upvotes and Engagement

• Upvotes represent genuine interest in a product.
• You may not use bots, scripts, or any automated means to generate upvotes or engagement.
• Creating multiple accounts to upvote the same product is prohibited.

8. Video Content (Shorts)

Technical Requirements

• Short promo videos must be vertical (9:16), between 5-60 seconds, and under 50MB.
• Videos must be directly related to the submitted product.
• You are responsible for ensuring you have the rights to all content in your videos (including music, voiceovers, screen recordings, and third-party assets).

License for Video Content

By uploading a short video ("Short") to VcodingList, you explicitly grant VcodingList all rights described in Section 5 above. In addition, you specifically agree that:

• VcodingList may repost, redistribute, and publish your video on any social media platform (including but not limited to TikTok, Instagram Reels, YouTube Shorts, X/Twitter, Facebook, and LinkedIn) under VcodingList's own accounts
• VcodingList may edit your video to add intros, outros, branding, captions, thumbnails, overlays, or other modifications for promotional purposes
• VcodingList will credit the product name and/or maker when reasonably possible, but is not obligated to do so in all cases
• This license is granted at no cost to VcodingList, and you waive any right to compensation for such use
• This license survives the deletion of your video or account from the Platform for content already distributed to third-party platforms

Representations

By uploading a video, you represent and warrant that:

• You are the creator or authorized rights holder of the video
• The video does not violate any copyright, trademark, or other intellectual property rights
• All persons appearing in the video have given their consent
• You have the legal authority to grant the licenses described in these Terms

9. Paid Services

VcodingList may offer paid features and services, including but not limited to Express Launch, Boost packages, and Sponsored placements. When purchasing paid services:

• All payments are final and non-refundable unless otherwise stated at the time of purchase
• Paid features are provided for the duration and scope specified at the time of purchase (e.g., "7 days of Boosted badge")
• VcodingList reserves the right to change pricing, modify, or discontinue paid features at any time. Active paid features will be honored for their purchased duration
• We are not responsible for outcomes resulting from paid services (e.g., specific traffic levels, conversion rates, or ranking positions)

10. Copyright and DMCA

VcodingList respects the intellectual property rights of others. If you believe that content on the Platform infringes your copyright, you may submit a takedown request to contact@vcodinglist.com with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of the material you claim is infringing and its location on the Platform (URL)
• Your contact information (name, email, address)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

We will review and respond to valid takedown requests promptly. Repeat infringers may have their accounts terminated.

11. Intellectual Property

The VcodingList name, logo, design, and all associated branding are the property of VcodingList. You may not use our branding without prior written permission. The Platform's source code, design, and architecture are protected by applicable intellectual property laws.

12. Indemnification

You agree to indemnify, defend, and hold harmless VcodingList, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party, including intellectual property rights; or (d) any content you submit to the Platform. This indemnification obligation will survive the termination of your account and these Terms.

13. Limitation of Liability

VcodingList is provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be available at all times, be error-free, or that any defects will be corrected. To the maximum extent permitted by law, VcodingList shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Platform.

14. Moderation and Termination

• We reserve the right to remove any content or terminate any account at our sole discretion, with or without notice.
• We may modify, suspend, or discontinue the Platform at any time.
• Violation of these Terms may result in immediate account termination.
• Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including but not limited to content licenses, indemnification, limitation of liability, and dispute resolution) shall survive.

15. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved as follows:

• Informal resolution: You agree to first attempt to resolve any dispute informally by contacting us at contact@vcodinglist.com. We will attempt to resolve the dispute through good-faith negotiation within 30 days.
• Binding arbitration: If informal resolution fails, the dispute shall be settled by binding arbitration. The arbitration shall be conducted in English by a single arbitrator.
• Class action waiver: You agree to resolve disputes with VcodingList on an individual basis and waive the right to participate in a class action lawsuit or class-wide arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

17. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by updating the "Last updated" date at the top of this page and, where appropriate, providing additional notice. Your continued use of VcodingList after any changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VcodingList regarding your use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and VcodingList.
